Terms of Service for Ermetica7 Themes

1. Definitions

• "Theme" refers to the collection of HTML, CSS, JavaScript, and other files sold by Ermetica7 as a website template.
• "You" or "Licensee" refers to the individual or entity that has purchased a license for the Theme.
• "End Product" refers to a customized, functional website created by you using the Theme for a personal, commercial, or client project.
  

3. Intellectual Property

All intellectual property rights, including copyright, in the Theme's design and codebase remain the exclusive property of Ermetica7. Your license does not grant you any ownership rights to the Theme itself, only the right to use it as outlined in these Terms.)

4. User Responsibilities

• Placeholder Content: All images, videos, and text content used in the Theme's live preview are for demonstration purposes only. These assets are not included in your purchase and are not covered by this license. You are solely responsible for replacing all placeholder content with your own properly licensed assets.
• Security: You are responsible for maintaining the security of your End Product, including updating any third-party libraries or dependencies if you choose to modify the theme's core structure.
• Lawful Use: You agree to use the Theme only for lawful purposes. You may not use the Theme to create any End Product that is defamatory, illegal, or infringes on the rights of others.
  

5. Payments, Delivery, and Refunds

• Payment: All payments for Themes are processed through our designated third-party payment provider. You agree to provide accurate and complete payment information.
• Delivery: Upon successful payment, you will receive a link to download the Theme files as a .zip archive.
• Refund Policy: Due to the digital nature of our products, all sales are final. We do not offer refunds or exchanges once a Theme has been purchased and downloaded.
• Please review the live demo and features carefully before making a purchase.
  

6. Support

We provide support for issues directly related to the original, unmodified Theme files.

• Our support services include:

1. Fixing any bugs or errors reported in the original Theme.
2. Answering questions about the Theme's features and functionality.
3. Assistance with theme customization or modification.

• Support does not include:

1. Resolving issues with third-party plugins or hosting environments.
2. Creating or modifying content for your End Product.
   

7. Disclaimer of Warranties

The Themes are provided "as is" and "as available," without any warranty of any kind, either expressed or implied. Ermetica7 does not warrant that the Themes will meet your requirements, be free of errors, or that their operation will be uninterrupted. You assume all risks associated with the use of the Theme.

8. Limitation of Liability

To the maximum extent permitted by law, Ermetica7 shall not be liable for any direct, indirect, incidental, special, or consequential damages (including, but not limited to, lost profits, business interruption, or data loss) arising out of the use of or inability to use the Theme, even if advised of the possibility of such damages.

9. Termination

This license may be terminated if you breach any of these Terms. Upon termination, you must immediately cease all use of the Theme and destroy all copies of the Theme files in your possession.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of U.E, without regard to its conflict of law provisions.

11. Changes to Terms

Ermetica7 reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website. Your continued use of our Themes after any such changes constitutes your acceptance of the new Terms.
